General Terms and Conditions

Here are the general terms condtions all registered users are obligated to comply with. Contact support in case you have a question. Failure to follow the rules, policies, and guidelines may result in the deletion of your post and/or user account, please read through:

Yuzzon, a partly fee-based and partly free internet advertising service, is operated as a classifieds portal for services, profiles, and more (hereinafter referred to as "listings"), which can be provided and viewed by private individuals as well as commercial customers. The internet service is owned by Yuzzon GmbH and operated by this company. Further information can be found in the imprint.

1.1 Scope and Application: the General Terms and Conditions of "Yuzzon GmbH" (hereinafter referred to as "Yuzzon") apply to the website www.yuzzon.com and all subdomains and web pages belonging to this domain.

These General Terms and Conditions apply to all orders, purchases, and legal transactions between Yuzzon on the one hand, and the users and advertisers of the internet service or applicants and entrepreneurs using the database (hereinafter referred to as "customer") on the other hand. If the term "customer" is used below, the provisions apply to both users of the internet service and advertisers. All mutual rights and obligations of the aforementioned contracting parties are determined exclusively by the content of the order accepted by Yuzzon and these General Terms and Conditions.

1.2 Conflicting Terms and Conditions: Conflicting terms and conditions only apply if Yuzzon has explicitly and in writing subjected itself to them.

1.3 Future Transactions: The Terms and Conditions also apply to future transactions between the contracting parties, even if reference is not made to them again in a future contract, provided that this provision does not apply to consumer transactions.

1.4 Changes to the Terms and Conditions Yuzzon reserves the right to change these Terms and Conditions at any time and without giving reasons. The customer will be notified of the changes by email. By using the internet service of Yuzzon, consent to the amended Terms and Conditions is deemed to be granted.

1.5 The "Privacy Policy" applies as part of these Terms and Conditions.

2.1 General, Advertising Information: The provisions of data protection in the current version of the Data Protection Act are to be complied with. The customer agrees that Yuzzon stores, uses, and analyzes the customer's provided and existing master and traffic data, as well as all data resulting from the business relationship, for its services and related services (e.g., administration, invoicing, data backup, data protection control, support, market research, studies, tailored offers, services with additional benefits, and overall service improvement) and utilizes evaluations or statistics and utilizes the results (e.g., publishing, providing to others). The customer also agrees that Yuzzon may use the same data to send information about products and services as well as special promotions and advertisements related to them, by mail, email, fax, telephone, or SMS. The customer can revoke their consent at any time in writing by email to admin@yuzzon.com or by mail to the address provided in the imprint. Yuzzon is also entitled to store and use IP address logs in accordance with legal provisions. Stored data is adequately protected by Yuzzon according to the current state of the art. Yuzzon is not liable for illegal interference by third parties (e.g., viruses, hacking). Yuzzon may engage third parties in the provision of its services and in the processing of data, while complying with relevant data protection regulations. Customers acknowledge that the data provided may be viewed by third parties.

2.2 Disclosure of Data by Yuzzon The customer expressly agrees and waives any claims, e.g., for violation of data protection, that the data provided by them may be stored and disclosed to government authorities (police, courts, authorities, association for unfair competition or other entities authorized to file claims under Section 14 of the Austrian Commercial Code) for investigations regarding materials/content distributed by the customer via Yuzzon or relating to illegal activities carried out by the customer. This includes activities in the area of private electronic communication. Furthermore, the customer agrees to the disclosure of data to any other third party whose rights are violated by the customer's distribution of content or unlawful activities carried out by the customer via Yuzzon, or who reasonably alleges such a violation. This particularly applies to the disclosure of data to third parties through requests for information under, for example, Section 18 (4) of the Austrian E-Commerce Act.

Special provisions for commercial customers: The customer expressly agrees that their (transmitted) data may be transmitted by Yuzzon to authorized credit protection associations and credit institutions for the purpose of creditworthiness checks. This consent can be revoked at any time. See 2.1.

2.3 Disclosure of Data by Customers Caution: Customers should exercise utmost care and caution when providing personal data on the platform. Yuzzon cannot be held liable for any misuse of data published/made available through the platform. It is expressly stated that personal data published/made accessible via the internet and/or in a print medium is no longer confidential. In such cases, Yuzzon has no control over compliance with data protection regulations by third parties.

2.4 Blocking, Deletion: Yuzzon will terminate the user account, block the customer, or delete the posted advertisement or other posted content, and terminate the contract immediately if it becomes apparent that a customer violates legal requirements, the applicable terms and conditions including advertising guidelines and terms of use, or otherwise acts contrary to good morals, the reputation, or the interests of Yuzzon or a partner/group company, or if the customer's behavior impairs the functionality of the websites. The customer has no claim for compensation. Yuzzon is entitled to the full agreed remuneration. Other claims by Yuzzon remain unaffected. In the event of account termination, customer suspension, deletion of an advertisement or other posted content, or cessation of the service, Yuzzon is entitled to delete all uploaded data (including photos) without any claim for compensation.

Special provisions for commercial customers:

Any granted benefits on the tariff/price, such as discounts, will be forfeited in the event of termination, and Yuzzon is entitled to demand the tariff according to the price list. In this case, the customer is required to promptly pay any differences between the agreed price and the price according to the tariff since the beginning of the contract.

2.5 For security reasons, the customer should only enter their username/password after they themselves have entered the URL: www.yuzzon.com, in the browser's address bar and accessed the Yuzzon page. The customer is solely responsible if they have disclosed their access credentials on counterfeit pages.

3.1. General Terms: The internet service provided by Yuzzon is understood as an advertising platform. Customers can place ads on this platform, and users can contact advertisers and enter into contracts. Ads placed on Yuzzon are not binding offers from Yuzzon. Yuzzon is neither a broker nor an agent. Contracts are exclusively made between customers. The provisions for ads also apply to other types of offers on Yuzzon, such as resumes/applicant profiles, etc. Therefore, Yuzzon is not liable for the conclusion or non-conclusion of a contract between customers, nor for the specific success of an ad. Yuzzon is not responsible for the accuracy of customer identity information or the accessibility of a customer through the provided contact details. If not legally required, the provisions for entrepreneurs (UGB or other relevant legal provisions) apply, rather than the Consumer Protection Act. Without written confirmation from Yuzzon, oral agreements, promises, and information from Yuzzon employees/sellers are not valid, except as provided by mandatory legal provisions (e.g., Consumer Protection Act).

Special provisions for commercial customers:

Advertisers who contract with consumers as entrepreneurs must comply with the relevant consumer protection provisions (especially the FAGG and KschG) before the consumer submits the contract declaration. See also Section 8.1 "Termination/Withdrawal" in the Terms and Conditions.

3.2. Access Data and Data The customer is obligated to keep their access data (e.g., username, password, etc.) confidential and protect them from unauthorized access by third parties. The customer must immediately report any misuse or unauthorized use of Yuzzon in writing. Until then, any access or action related to the customer's user account will be attributed to the customer.

If the customer does not log in for a period of 12 months, Yuzzon reserves the right to deactivate the account without any claims from the customer.

3.3. Conclusion of a Contract: The customer's provided data must be correct, complete, truthful, and in accordance with legal requirements.

Special provisions for commercial customers:

The information obligations according to § 6 (1) ECG or § 63 Trade, Commerce, and Industry Regulation Act must be observed. Data changes (e.g., company name, address) must be reported to Yuzzon in writing immediately or at the latest within 2 weeks of the change. Yuzzon is entitled to send legally effective statements to customers at the last known address.

Yuzzon is entitled to request suitable evidence from customers at any time (business license, authorization, commercial register excerpt, etc.).

Yuzzon reserves the right to reject, terminate, block the customer, or delete ads without any compensation claims from the customer, especially for the following reasons:

  • Violation of these Terms and Conditions, including ad guidelines and usage terms.
  • Third-party advertising or linking to other websites.
  • Reasonable suspicion of abusive use of the internet service or Yuzzon's services.
  • Violation of legal provisions, essential contractual provisions, good morals, reputation, or legitimate interests of Yuzzon or a partner company.
  • Termination of the contractual relationship between the customer and Yuzzon or the customer and a partner company due to the customer's violation of essential contractual provisions.
  • Incomplete or incorrect information provided during the order or failure to provide required evidence or documents.
  • Lack of necessary official approvals (e.g., business license), lack of legal or contractual capacity.
  • Payment default to Yuzzon or a partner company (see Section 2.1).
  • Disputed ads by the Austrian Advertising Council.

All rights and obligations of Yuzzon's internet service also apply to the customer's employees or other third parties (agents) who have been authorized to use this service.

3.3.1. Self-registration on the platform: Through self-registration (on Yuzzon), a contractual relationship of indefinite duration is established between Yuzzon and the customer in accordance with the respective terms and conditions.

Registration is free of charge and enables free use of additional features, such as the search agent and watchlist, and is a prerequisite for placing advertisements on the Yuzzon online portal. There is no entitlement to registration.

3.3.2. Conclusion of a package contract (for commercial customers only) Once Yuzzon accepts the customer's order (offer) by providing the service (e.g., sending access data), the contract is concluded.

Customers with a package contract cannot register themselves but will be created by Yuzzon after the contract is concluded. If inaccuracies in the entered data are not disputed within 2 working days from the online posting (sending of access data), the creation by Yuzzon is considered to be accepted without defects.

Package contracts allow for the posting of a specific agreed-upon quota of advertisements for a certain price. Additional costs may arise from selected additional options or exceeding the quota.

Yuzzon reserves the right to make the acceptance of an order dependent on a reasonable security deposit or prepayment and to determine the form of security (e.g., bank guarantee).

The customer is responsible for any public fees, charges, and taxes that may be associated with the conclusion of the contract. If new fees, charges, or taxes are prescribed due to changes in the legal situation that were not currently in effect at the time of contract conclusion, the customer is also responsible for them.

The posting of an advertisement may only be carried out by the customer as the contractual partner and only for the purpose of self-promotion. Any transfer to third parties requires the prior express written consent of Yuzzon. Therefore, agencies or other intermediaries must indicate the client for each package booking.

The contract between the customer and Yuzzon is concluded for a fixed term as specified in the order and is automatically extended by 12 months unless terminated in writing in a timely manner (see section 8.4). In this case, the price for the provided service will be automatically adjusted to the currently valid price list.

3.4. Placing advertisements: The complete guidelines for placing advertisements can be found in our ad guidelines; these guidelines are considered part of the present terms and conditions. Advertisements that do not comply with these guidelines will be deleted without replacement.

The customer acknowledges that the contract for placing advertisements or purchasing additional options/services with Yuzzon is concluded by written agreement, email or pop-up acceptance, interactive selection of products/services on the platform, acceptance of the binding offer, or actual provision of services.

The placement of an advertisement is only done in the offered format (layout, fields, text length, etc.). Yuzzon has the right to publish the advertisement up to 48 hours (or in special cases or circumstances, even longer) after its capture.

Yuzzon can expand or modify its services at any time and is entitled to display advertisements on the site. Yuzzon is also entitled, but not obligated, to optimize the documents submitted by the customer (e.g., photos, videos, etc.) for publication or modify them for security reasons. In this case, Yuzzon is entitled to place its company name and/or logos of appropriate size and placement on the advertisement or multimedia object.

Upon the customer's request, the placement of the advertisement can also be carried out by Yuzzon employees. However, an additional fee must be paid by the customer in this case. The documents must be compatible, in accordance with Yuzzon's specifications, and fully submitted to Yuzzon no later than 3 working days before the agreed publication. The customer is responsible for the accuracy of the data provided by them and the information transmitted.

The customer guarantees that the documents are suitable as agreed. Yuzzon assumes no liability for delivered documents and is not obligated, unless otherwise expressly agreed in writing, to check them for suitability in advance or to return them to the customer. In any case, the return will be at the expense and risk of the customer placing the advertisement.

The customer is responsible for any delays and costs arising from a delayed submission by the customer or as a result of the content of the advertisement.

Upon the request of the advertiser, Yuzzon makes changes to an advertisement designed by Yuzzon during the publication period. However, this is only possible if such changes are technically feasible and reasonable for Yuzzon. Such changes are free of charge for the first time, and thereafter, they will incur a fee. Yuzzon assumes no liability for these changes.

Yuzzon has all rights to the selection, coordination, arrangement, placement, and expansion of an advertisement (e.g., advertising, hyperlinks, features, offer calculators).

Non-competition agreements are not possible.

The advertisements will be automatically deactivated after the agreed duration. If an unlimited advertisement placement is agreed, the advertisement will remain active until the customer deactivates or deletes it, but in any case for a maximum of 12 months.

Yuzzon is entitled to review the advertisement for compliance with legal requirements and suggest necessary changes, but is not obliged to do so. Yuzzon may make legally necessary interventions without prior consultation with the customer (e.g., deleting links to competitors, labeling as "advertisement," etc.).

Special provisions for commercial customers:

Compliance with the agreed payment deadlines is a fundamental condition for the performance by Yuzzon. In case of payment default, Yuzzon is therefore entitled to interrupt the service or terminate the contract with immediate effect without setting a deadline.

Commercial providers (not purely private occasional sellers) are obliged to indicate this (commercial) fact in accordance with the provisions of the Trade Regulations, in particular those regarding name and designation according to the Trade Regulations and the Commercial Code.

Real estate sales or brokerage must always be carried out in accordance with the legal provisions and are prohibited without the necessary brokerage contract.

If a customer has multiple locations or branches, a separate access must be ordered for each location. The prices according to the price list apply to each location.

3.4.1. Main parameters for the ranking of search results: Yuzzon allows users to sort the search results based on various criteria or narrow down the selection of search results by different criteria (e.g., category, price, or location). In addition, Yuzzon offers various paid products to the respective provider to highlight an advertisement, including featured, top, and bump up Ads.

3.4.2. Further publications in other media: The publication of the advertisements, including the data provided by the advertisers, is done on www.yuzzon.com, Yuzzon also has the right, but not the obligation, to publish the advertised content in affiliated partner media (e.g., as listed under 2.1) and/or other media (e.g., as online/print advertisements, through electronic or digital means, email, telephone, SMS/MMS, etc.) is part of the subject matter of the contract. The customer will not incur any additional costs as a result. The customer acknowledges that there may be variations in quality between online and print materials compared to the original documents (e.g., photos). Yuzzon assumes no liability for deviations in print quality or transmission errors.

3.5. Customer's Responsibilities: The customer is responsible for reviewing and, if necessary, modifying the advertisement in terms of content, legality, timeliness, accuracy, etc., as well as deactivating and deleting it from the time of activation until the end of the agreed service period. By entering the advertisement, the customer expressly confirms its publication in this form; Yuzzon assumes no liability.

Therefore, it is the customer's obligation to immediately deactivate or delete no longer current advertisements.

The customer is not allowed to place multiple advertisements for the same item. Advertisements must be placed in the appropriate category or a specific region. Yuzzon reserves the right to publish advertisements under the appropriate category without prior notification to the customer, or to delete the advertisement in the wrong category without simultaneous correction by publishing it in the correct category, as well as multiple advertisements.

Offered used items must be physically in the customer's possession.

3.6. Additional Products and Services: Customers have the option, for example, during ad submission, in their ad management, etc., to purchase additional products/services (hereinafter referred to as "additional options"). If there are specific terms and conditions applicable to certain additional products/services as supplements to these terms and conditions, they will be displayed to the customer prior to use and must be accepted by the customer. The price according to the price list for such additional products/services is due immediately unless otherwise specified. The respective additional option(s) will be activated only after the price/fee has been paid.

The additional products are only valid for the ad they were booked for. If the ad is deleted (or deactivated, copied, etc.), the remaining duration of the chosen service will also expire. Additional products cannot be transferred to other ads.

Additional options are valid for the agreed duration and volume.

Special provisions for commercial customers:

For commercial package contracts, Yuzzon is entitled but not obligated to invoice all additional options once a month, possibly combined with other services.

3.7. Conditions for Display Advertising (for commercial customers only): All information, documents, materials, and files required for the publication of the respective advertisement (graphics, rich media banners, texts, links, and others) must be provided by the customer to Yuzzon no later than 3 working days for standard ad formats (according to IAB) or 5 working days for other ad formats before the scheduled initial integration on the website, in a complete, error-free, and compliant manner according to our requirements.

The customer is responsible for examining the published advertisement immediately after its publication and must report any errors within two working days after the first publication. After this deadline, the online advertisement and its manner of publication are deemed accepted.

Yuzzon has the right to review the submitted advertising materials for their suitability and technical compatibility (including appropriate format, display technology, file sizes, etc.) and may return them to the customer for adjustment. Yuzzon is also entitled, after prior agreement with the customer, to make these adjustments themselves and charge the customer for the associated costs.

The customer assumes responsibility for the advertisement. In particular, the customer is liable for ensuring that the advertisement complies with press and competition law regulations. The customer assures that they have obtained all necessary usage rights from the owners of copyrights, trademarks, performance protection, personality, and other rights related to the materials provided or used by them (e.g., texts, photos, graphics, files, audio recordings, and videos, etc.) or that they have acquired such rights.

If Yuzzon is unable to provide a potentially contractually agreed-upon service volume (e.g., ad impressions) for a customer within the agreed-upon timeframe, Yuzzon is entitled and obliged to deliver the outstanding service volume immediately following the respective order or following a subsequent order already validly booked by the customer, at Yuzzon's discretion and within a reasonable period. In such cases, there is no entitlement to a refund of payments already made for a service volume.

Yuzzon is released from any claims arising from the customer's non-compliance with the technical requirements or the submitted advertising material for publishing the advertisement or determining technical advertising information (such as the number of ad impressions).

If error-free order processing cannot be ensured, Yuzzon is entitled to remove the material from the site immediately, regardless of any potential damage, and is exempt from any liability associated with such action.

Data must be submitted electronically via email attachment. These data must comply with the requirements for marking commercial communication under the E-Commerce Act (ECG), as well as, if applicable, the relevant provisions of the Distance Selling Act and the Media Act.

In particular, the submitted data must allow for the lawful identification of commercial communication advertisers.

Yuzzon does not guarantee the distribution of ad impressions during the advertising campaign. Yuzzon is entitled to reject or promptly block advertising placements and links for editorial, legal, technical, or other reasons (such as violation of good manners or Yuzzon's reputation), without prior consultation with the customer, although the customer will be informed of the measure as soon as possible.

For contracts and invoicing related to display advertising, the provisions for package contracts apply in terms of content.

Unless otherwise stipulated in section 3.7, the general liability and warranty provisions stated in point 6 apply.

3.8. Conditions for Software Services and Programming (for commercial customers only): If Yuzzon provides software services to the customer, the customer acknowledges that all rights (copyright, performance protection, and other intellectual property rights) to the software service belong to Yuzzon or its licensors. Unless otherwise agreed, information, data, documents, ideas, graphics, program code, presentations, concepts, and other technical materials, etc., remain the intellectual property of Yuzzon and, in any case, are subject to confidentiality as business and trade secrets. Any use, particularly reproduction, modification, publication, public provision, broadcasting, etc., requires the explicit consent of Yuzzon. By virtue of this contract, the customer only acquires a limited right of use for the agreed purpose. The granting of sublicenses or any other form of rights transfer by the customer is prohibited. The obligation of confidentiality remains in effect even after the contractual relationship between Yuzzon and the customer ends.

The customer must provide all necessary documents, information, data, etc. (collectively referred to as "information") in a timely manner and in accordance with the qualitative and technical requirements of Yuzzon. The advertiser bears any damage or additional costs incurred by Yuzzon due to incorrect or delayed submission of information by the customer.

Yuzzon assumes no liability for the compatibility of the software and/or components with the customer's software and/or hardware. Yuzzon is not liable for unauthorized modifications to the software or for application errors caused by the customer.

In the event of exceeding the promised deadlines, despite efforts by Yuzzon, the customer has neither the right to withdraw nor the right to claim damages. This is subject to any different mandatory legal provisions for consumers.

Yuzzon is entitled, as long as possible, to include and link its company name in relation to all services provided to the customer. This includes the display of the Yuzzon logo in an appropriate size.

5.9. Confidential Advertisements (for commercial customers only):

Confidential advertisements are currently offered only for commercial customers.

Inquiries regarding confidential advertisements should be handled by the customer in accordance with legal regulations and data protection principles. The customer shall hold Yuzzon completely harmless and indemnify them in this regard.

For confidential advertisements, inquiries will be forwarded to the address (email, fax, mail) provided by the advertiser. The advertiser assumes the risk and responsibility for the transportation or transmission. Inquiries with explicit confidentiality instructions will not be forwarded.

Yuzzon offers support via email and telephone for both commercial and private customers. The respective connection charges or costs for premium-rate numbers, for example, are borne by the customer.

The support availability hours and the scope of services provided by Yuzzon can be found under "Contact". Yuzzon cannot guarantee the availability of support.

In the event of repeated use of these support services from Yuzzon, Yuzzon is entitled to invoice for the services.

Oral information provided is not binding. Yuzzon shall not be liable in this case.

The execution of the requested services by Yuzzon will be carried out in the manner chosen by Yuzzon and within normal working hours.

Complaints submitted within the framework of the internal complaint management system will be carefully reviewed. After a processing time appropriate to the complexity and significance of the issue, the commercial user will be informed of the outcome of the internal complaint procedure.

Yuzzon is willing to work with mediators to achieve an out-of-court settlement of any disputes with commercial users. However, before initiating such a mediation process, commercial users should attempt to resolve their concerns through Yuzzon's internal complaint management.

The customer expressly acknowledges that the exclusive copyright and intellectual property rights to the overall appearance as well as parts of the advertisements created by Yuzzon, as well as advertisements posted by third parties and other content published on the Yuzzon platform (text, trademarks, photos, databases, layout, etc.), belong solely to Yuzzon or other third parties. Unless otherwise agreed upon in writing with the customer, payment of the fee does not transfer any rights to the advertiser.

Therefore, the customer is not entitled to use advertisements created by Yuzzon outside of the Yuzzon website, unless expressly agreed upon in writing with Yuzzon.

The customer is not permitted to influence the design of Yuzzon's web pages or an advertisement (e.g., visually, structurally) unless otherwise agreed upon in writing with Yuzzon.

By posting or submitting the advertisement (e.g., through self-entry, data interface), the advertiser, on behalf of the rights holder or themselves, grants Yuzzon the exclusive and transferable right to use, distribute, modify, edit, publish, and make publicly available these contents without temporal or spatial limitations within the scope of Yuzzon and its partner/corporate media. The rights granted also include the right for Yuzzon to use the advertisements, etc., for self-promotional purposes. However, Yuzzon has the right, but not the obligation, to defend against unlawful infringements on transferred usage rights in its own name or to assert resulting claims in court if necessary. In the event of defense by Yuzzon, the advertiser will provide the best possible support. The advertiser must immediately and in writing notify Yuzzon of any third-party claims that are brought to their attention.

Yuzzon assumes no responsibility for the timing of when advertisements go online and/or are deactivated/deleted.

Yuzzon is not liable for the specific success of an advertisement or the enforceability of a contract concluded through the marketplace (e.g., purchase of a product). Yuzzon is also not liable for the services offered on the marketplace, including any warranties or guarantees, or for damages, product liability, etc. The offered goods, services, etc., do not constitute binding offers from Yuzzon. Yuzzon is neither a broker nor an agent. Yuzzon has no obligation whatsoever to obtain or disclose additional information about the services,  offered or advertised by customers.

If accessible content or advertisements are posted and made accessible by customers or on their behalf, Yuzzon assumes no liability of any kind for the content, accuracy, timeliness, reliability, misuse, typographical errors, etc., of customer identity information or the accessibility of individuals based on the information provided.

The customer of the internet service declares that they will use the internet service only within the framework of contractual or legal provisions and without infringing upon the rights of third parties. In particular, the customer declares that they will not use, edit, alter, delete, or obscure the copyrighted, competition, trademark, and other rights of third parties without their consent.

In any case, the customer agrees to indemnify and hold Yuzzon completely harmless from any claims by third parties arising in their area of responsibility. Therefore, the customer undertakes to indemnify Yuzzon completely (including attorney and court costs) if Yuzzon is held civilly or criminally liable, judicially or extrajudicially, in particular due to private lawsuits for defamation, libel, damage to credit under criminal law, or proceedings under the Media Act, the Copyright Act, as well as other intellectual property rights, the Unfair Competition Act (UWG), or civil defamation and/or damage to credit (Section 1330 of the Austrian Civil Code - ABGB).

The warranty provided by Yuzzon to customers only extends to the paid advertisement being displayed in accordance with the current customary technical standard and the corresponding availability of data. Free advertisements or services (search agents, watchlists, delivery of inquiries) do not entitle the customer to make claims. No liability or compensation is provided for errors that do not significantly impair the meaning of the advertisement.

Yuzzon is not liable for any damages incurred by the customer as a result of the misuse of data transmitted to third parties (e.g., in ads, emails, applications, referrals, etc.).

The advertisements created or modified by Yuzzon, whether automated or manual, always represent a draft that must be approved by the client after a thorough factual and legal examination.

Claims: Any complaints regarding the advertisement must be reported in writing by the advertiser to Yuzzon immediately, but no later than 2 working days after the publication/change of the advertisement, unless it was self-entered/modified. After that, the advertisement is considered to be free of defects.

In the event of a defect in a paid advertisement for which Yuzzon is responsible, the advertiser, at Yuzzon's discretion, is entitled to a new initial advertisement of the same scope as the defective advertisement. If improvement fails within a reasonable period, the advertiser may demand a price reduction only after further reasonable notice and attempts at improvement. Furthermore, the advertiser has no other claims, unless otherwise required by law.

The advertiser is particularly responsible for accurately entering the advertisements. Photos and other materials must be uploaded in the format defined by the menu and in perfect condition. Yuzzon cannot guarantee the accuracy of advertisements or changes made by phone.

Customers are responsible for independently and externally backing up and storing any data they require (e.g., for order processing, evidence, archiving, etc.) using suitable storage media. Yuzzon is authorized to delete all data, including photos, three months after the expiration/deletion (deactivation, etc.) of the advertisement.

Yuzzon is not liable for the compatibility of the internet service with hardware and software, for continuous availability, for viruses, misuse, or damages caused by the customer's improper operation due to unsuitable hardware or software, as well as malfunctions resulting from internet connectivity or the use of data or the internet service. Customers are also responsible for the links they access.

Yuzzon is also not liable for a server outage lasting no longer than 3% but at least 48 hours within the contractually agreed advertising period. Yuzzon reserves the right to temporarily restrict or suspend its services for necessary reasons (e.g., maintenance, security, capacity, improvement). These measures do not constitute an outage and cannot be added to the outage time, even if they are implemented within the same period as an outage.

Yuzzon explicitly points out that unauthorized copying, unauthorized linking (framing), or the publication of advertisements disguised as the offer of a third party cannot be completely excluded. Yuzzon will make reasonable efforts, to the extent technically and legally possible and reasonable, to prevent such actions. The advertiser hereby grants Yuzzon the necessary consent for this purpose. However, the advertiser has no claims against Yuzzon arising from any unauthorized actions taken by third parties.

If Yuzzon is liable for damages according to legal provisions, its liability is limited to intentional acts and gross negligence. Any further liability of Yuzzon, particularly for slight negligence, atypical damages, lost profits, defects, indirect and consequential damages, damages to third parties, etc., is excluded. In any case, Yuzzon's liability is limited to the amount/price of the specific order with the customer. The burden of proof for Yuzzon's fault lies with the customer. Claims for damages expire within six months. This is without prejudice to any mandatory legal provisions to the contrary (e.g., consumer protection laws).

Yuzzon is not liable for damages due to force majeure (e.g., strikes, war crimes, earthquakes).

7.1. General Terms: Unless otherwise agreed, the fees resulting from the current price list, which can be viewed at www.yuzzon.com in the respective ad placement (price lists for package offers can be requested at admin@yuzzon.com), apply. Yuzzon reserves the right to charge customers fees for additional options or the use of services, etc. The prices are listed in the price list for additional options. Customers are responsible for all costs and expenses associated with their payment (e.g., bank fees, handling fees, such as transfer fees). Amounts/prices to be paid by the consumer include statutory value-added tax, charges, and other surcharges (gross prices).

Payment is generally made before the activation of the service (e.g., advertisement, additional option, service, etc.) and must be made using the payment methods specified by Yuzzon (credit card, online banking, vouchers, prepaid credit, etc.).

Yuzzon is entitled to issue a consolidated invoice for all services provided by Yuzzon, regardless of whether these services are owed under different contracts.

When paying through our payment provider, an invoice can be requested by activating the option and entering the master data. When paying by bank transfer, an invoice can be requested for the respective ad in the user account. This invoice will be sent exclusively by email.

Yuzzon reserves the right to round amounts up or down to the nearest cent.

Invoices must be disputed within 14 days of receipt; otherwise, they will be deemed accepted by the customer.

When providing payment receipts, commercial customers must provide the customer number, while private customers must provide the Yuzzon code and/or their username (email address). Any costs incurred for research will be charged to the customer. Only with the correct allocation does the payment have a debt-relieving effect.

When paying by credit card or direct debit, the customer must ensure that the credit card or account is not blocked or expired. Otherwise, any resulting payment delays will be at the customer's expense. In such cases, default interest may be charged to the customer.

If payment is processed on the platform through a payment provider, Yuzzon is not liable for the security of the data or any incorrect bookings caused by errors of the payment provider.

Yuzzon reserves the right to offer payment for individual advertisements, additional options, or services through preloaded credit (prepaid). In this case, customers must acquire sufficient credit. Customers can check their account balance at any time in their "Account" (My Account). Claims must be made within 14 days of the last modification; otherwise, the account is deemed accepted.

Prepaid vouchers or credit loaded through a payment provider are valid for 12 months. There will be no refund for unused credit.

Yuzzon is not liable for misuse, theft, loss, etc. of access data, credit, or any other data and/or information related to the credit account that is not attributable to Yuzzon.

If the advertiser fails to meet delivery deadlines and, as a result, the advertisement cannot be published or published on time, Yuzzon's claim for payment of the agreed compensation remains unaffected. This also applies in the event that Yuzzon blocks the advertiser or deletes the advertisement for reasons attributable to the advertiser.

Special provisions for commercial customers:

Prices are exclusive of statutory value-added tax and all other applicable fees, taxes, and levies (e.g., 5% advertising tax).

If taxes or other charges are introduced or imposed retroactively, these will be borne by the customer.

7.2. Invoicing for Package Contracts (for commercial customers only): The ad packages are invoiced directly to the customer. However, it is possible to purchase additional ads, services, placements, and additional options (e.g., top ads, featured ads, bump up) directly in the administration area. Payment for these must be made immediately upon booking through the payment provider. Yuzzon reserves the right to invoice the additional options and additional ads collectively for a billing period.

Invoices must be paid immediately and without deductions upon receipt unless otherwise agreed.

In the event of changes to ad prices, the new conditions take effect immediately for ongoing orders. The price is fixed for the period of any advance payment. The new price applies from the next invoicing. Sufficient notice will be given regarding price adjustments.

The timeliness of payment is determined by the receipt/credit on the Yuzzon account. In case of doubt, the payment will be credited to the oldest debt of the customer.

In the event of payment default, Yuzzon is entitled to suspend services immediately without setting a grace period or to terminate the contract with immediate effect, without any claims (e.g., damages) from the customer. However, Yuzzon's claim for the agreed compensation for the contract duration remains unaffected. Any discounts granted on the tariff/price, such as discounts, are forfeited in the event of termination, and Yuzzon is entitled to demand the tariff according to the price list. In this case, the customer must pay any differences since the start of the contract.

In case of payment default, the customer will be charged statutory default interest according to § 352 UGB (Austrian Commercial Code). Furthermore, the customer must reimburse all reminder and collection fees as well as attorney's fees and court costs incurred for the enforcement of claims.

The withholding of payments and the offsetting of customer claims against claims of Yuzzon are excluded.

Yuzzon reserves the right to change the contract/billing start date, even if a different date is specified in the contract, to the 1st or the 15th and to invoice pro-rata for the period before or after.

7.3. Invoice Form for Package Contracts (for commercial customers only): Customers receive invoices and reminders in paper form. Yuzzon reserves the right to switch to electronic invoicing in accordance with legal requirements. Customers will receive all necessary information regarding the switch and the requirements in writing, at least 1 month in advance. If customers wish to continue receiving paper invoices after the switch to electronic invoicing, Yuzzon reserves the right to charge a fee (e.g., environmental fee, processing fee) if legally permissible.

If invoices are sent via email, customers will receive them at the provided email address. Invoices can also be viewed and downloaded in the administration area. The customer must promptly review these invoices. Yuzzon points out that for electronic invoicing, a direct debit authorization from the advertiser is required.

The invoice is deemed received as soon as it can be accessed or brought to the customer's attention under ordinary circumstances (e.g., receipt of the email).

If the customer chooses the payment method of direct debit authorization and it cannot be processed for reasons not attributable to Yuzzon (e.g., insufficient funds or the customer failing to inform Yuzzon of any changes to their bank details), Yuzzon is entitled to switch the payment method for this customer to bank transfer until further notice, and Yuzzon is not obliged to inform the customer about this. For each such returned direct debit, Yuzzon is entitled to charge the customer any bank fees incurred and a reasonable processing fee.

8.1. General Terms: The transmission of the termination of the contractual relationship by Yuzzon via email is sufficient and is deemed to have been received upon confirmation of delivery by the customer's server or email service.

8.2. Notice for consumers regarding paid services (e.g., paid ad placement) 11.2.1. Notice of the consumer's right of withdrawal according to § 3 KschG If the consumer has not submitted their contractual declaration either in the premises permanently used by the entrepreneur for their business purposes or at a stand used by the entrepreneur for this purpose at a fair or market, they can withdraw their contract offer or withdraw from the contract. This withdrawal can be declared up until the conclusion of the contract or within 14 days thereafter. The running of this period begins with the delivery of a document that contains at least the name and address of the entrepreneur, the necessary information for identifying the contract, as well as instructions regarding the right of withdrawal, the withdrawal period, and the procedure for exercising the right of withdrawal, to the consumer, but no earlier than the conclusion of the contract in the case of sales contracts for goods, starting from the day the consumer obtains possession of the goods. If the delivery of such a document has been omitted, the consumer has the right of withdrawal for a period of twelve months and 14 days from the conclusion of the contract or delivery of the goods; if the entrepreneur provides the document within twelve months from the start of the period, the extended withdrawal period ends 14 days after the time the consumer receives the document. The consumer does not have the right of withdrawal:

  1. if they initiated the business connection with the entrepreneur or their representative for the purpose of concluding this contract themselves,

  2. if there were no discussions between the parties or their representatives prior to the conclusion of the contract, or

  3. in the case of contracts where both parties are required to perform immediately, which are typically concluded by entrepreneurs outside of their business premises, and the agreed consideration does not exceed 25 euros, or if the company, by its nature, is not operated in constant business premises and the consideration does not exceed 50 euros, or

  4. in the case of contracts subject to the Distance and Off-Premises Contracts Act or the Insurance Contract Act, (...)

The declaration of withdrawal is not bound to any specific form. The withdrawal period is considered observed if the declaration of withdrawal is dispatched within the period.

8.2.2. Right of withdrawal according to FAGG Right of withdrawal: You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us, Yuzzon (Yuzzon GmbH, admin@yuzzon.com), by means of a clear statement (e.g., a letter sent by post or email) about your decision to withdraw from this contract. You can use the attached model withdrawal form, although it is not required.

To meet the withdrawal deadline, it is sufficient for you to send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal: If you withdraw from this contract, we shall reimburse to you all payments received from you, including the delivery costs (except for any additional costs arising from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your withdrawal from this contract. We will carry out such reimbursement using the same means of payment as you used for the original transaction, unless we have expressly agreed otherwise. Under no circumstances will you be charged any fees for this refund.

If you have requested that the services begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the time you inform us of the exercise of your right of withdrawal, compared to the overall scope of the services provided for in the contract.

No right of withdrawal: Attention: Your right of withdrawal expires prematurely if we have fully performed the requested service and have only begun to execute the service after you have given your explicit consent and at the same time have confirmed your knowledge that you will lose your right of withdrawal upon complete fulfillment of the contract by us. The service provided by Yuzzon is deemed to be fully fulfilled at the time of activation.

The customer can deactivate their advertisement (or additional product, service, etc.) at any time before the agreed-upon time expires. This does not constitute a withdrawal in the sense of the KSchG or FAGG. In this case, the customer remains obliged to pay the full remuneration.

8.3. Termination of the contract for self-registration (private/commercial) Contracts based on these terms and conditions can be terminated by the customer at any time by deleting their account. After the termination of the contract, the user will no longer have access to the information provided or generated by them. Legal (especially data protection) rights of the user remain unaffected.

Yuzzon is entitled to terminate the contract at any time for an important reason (extraordinary termination). Important reasons include the reasons stated in section 3.3.

8.4. Termination of the Package/Banner Contract: Contracts based on these terms and conditions can be terminated for one of the following reasons:

Expiration of the agreed contract duration.

If a termination option is agreed upon, 30 days prior to the main due date of the contract.

Consumption of an agreed quota.

Discontinuation of services by Yuzzon.

Yuzzon is entitled to terminate the contract at any time for an important reason (extraordinary termination). Important reasons include the reasons stated in section 3.3.

A regular or extraordinary termination by the customer must be in writing, and an email is sufficient. However, in the case of an email, the termination is considered received by Yuzzon only upon receipt of a written confirmation of termination.

After the termination of the contract, the user will no longer have access to the information provided or generated by them. Legal (especially data protection) rights of the user remain unaffected.

Yuzzon reserves the right to modify, supplement, or remove ads that do not comply with the specified guidelines or represent an impermissible item without further notice.

In the event of a violation of these guidelines, ad costs and any payments made will not be refunded.

9.1 User Account Only one user account is allowed per person. If multiple user accounts can be attributed to one person, they will be deactivated without prior warning. Yuzzon is entitled, but not obligated, to request appropriate proof (such as a photo ID) from the customer.

In case of repeated violations or disregard of relevant warnings, as well as intolerable behavior, Yuzzon reserves the right to temporarily or permanently deactivate the user account.

9.2 Content Ensure that your ad represents a service appropriate for Yuzzon.

Describe your offers truthfully and completely (including any defects, if applicable).

Each ad may only contain one item/service or a combination of similar items (e.g., book collections).

Avoid ads that do not correspond to the promotion of a service, especially if it includes advertisements, donation requests, or pure information.

It is prohibited to include search terms, brand names, etc. in the ad that are not relevant to the item description.

Avoid insults, harassment, assaults, accusations, defamation, political or discriminatory statements, as well as offensive images and texts that violate good manners.

Ads can be published in theoretically any language. additionally, you can add translations to the original text. 

Use only images and texts that you have created or obtained proper permission to use.

You are solely responsible for the content and legal permissibility of your ads. You commit to carefully review and respect applicable laws and the rights of third parties. The updating, deactivation, and deletion of ads are your responsibility from the moment of ad submission until the end of the agreed performance period. By entering the content, you expressly confirm its publication in this form; Yuzzon assumes no liability. Therefore, you are obligated to immediately deactivate or delete ads that are no longer current (e.g., sale of offered goods or services).

If you, as a private seller, exclude the warranty obligation for the item you offer, please explicitly state it in the ad text.

Observe the applicable anti-discrimination law and equal treatment law, which prohibit discrimination based on a person's origin and are generally legally enforceable.

All ads must comply with the applicable local law, good manners, and ethical principles.

9.3 Price Indication: No price field must be filled, users have the option but not the obligation to include a fixed selling price in the ad.

In the case of contract takeovers, such as mobile phone contracts, indicate the monthly costs.

Exchange ads (services for services) are allowed unless they violate other terms and conditions.

9.4 Images: Published images must be directly related to and depict the offered item. Copying photos from other ads or the internet constitutes a copyright infringement and will be deleted. When advertising tickets and vouchers, ensure that the relevant voucher or QR code is not visible. 

9.5 Links and Contact Information: Links to external websites (such as web addresses, email addresses, QR codes, or similar) and media companies not affiliated with Yuzzon are not allowed in ads.

9.6. Categories/Sections

Publish your ad only once in the most relevant category at the same time. Duplicate ads will be rejected without notification or refund of any costs.

Similarly, republications of an ad within a short period (30 days) after its deletion will be rejected without refund of any costs. In addition to deletion, Yuzzon reserves the right to reposition the republished ad. In case of repeated systematic republications of ads within a short period after their deletion, Yuzzon reserves the right to reposition all ads of the offending advertiser to encourage compliance with legal requirements. The sanction of repositioning all ads will be maintained for a reasonable period corresponding to the repeated systematic violation.

Reposting goods or services during the ad's runtime is strictly prohibited.

9.7. Ads that require commercial listing

Regardless of tax liability and possession of a trade license, we classify providers who regularly or with a high volume or with the intention of making a profit advertise goods or services as commercial.

9.8. Special provisions for commercial customers

In those areas where there are specific advertising products for commercial customers, these advertising products must be selected.

If you are a commercial customer, you must indicate this as "commercial" during the registration of your user account.

Your ads must comply with legal regulations, especially those of the E-Commerce Act, the Consumer Protection Act, the Unfair Competition Act, and the Trade Regulations. If you have any doubts, we recommend contacting the Chamber of Commerce responsible for your company.

If you wish to display a company logo or link to your website, we offer these options within the framework of a package contract (for a quote request).

9.9. Liability

Yuzzon is not obligated to review ads for legal permissibility or infringement of third-party rights or to inform the advertiser thereof.

The full responsibility for the form and content of the ads lies with the respective advertiser. The advertiser undertakes to refrain from disseminating pornographic, violence-promoting, or otherwise offensive content.

10.1. Confidentiality: Information, data, documents, trade secrets, ideas, know-how, codes, etc. (referred to as "Information") that are disclosed to the customer in the course of the business relationship with Yuzzon are subject to strict confidentiality, regardless of the means of disclosure (electronic, print, etc.). Excluded are those pieces of information that are already generally public knowledge or otherwise publicly accessible, or expressly designated as non-confidential by Yuzzon. Therefore, the customer is prohibited from using confidential information for purposes outside the scope of the agreement or providing such information to unauthorized third parties. The confidentiality obligation shall remain in effect even after the termination of the contract.

10.2. Succession: All rights and obligations shall be assignable to successors in title (individual, joint succession). The transfer of rights and obligations to third parties is not permitted without the express prior written consent of Yuzzon.

10.3. Written Form: Oral collateral agreements do not exist. Any changes and additions to agreements concluded with Yuzzon in the course of using the Internet service require written form; this also applies to collateral agreements and assurances, as well as subsequent contractual amendments, and the waiver of the written form requirement.

10.4. Severability Clause: The invalidity of individual provisions does not affect the validity of the remaining provisions of the Terms and Conditions, and in place of the invalid clause, a valid clause shall be deemed to have been agreed upon that comes closest to the intended purpose and economic and legal intent of the former provision. This applies mutatis mutandis to the event of a gap in the provisions.

10.5. Jurisdiction and Applicable Law: Austrian law, excluding the reference provisions of private international law or the United Nations Convention on Contracts for the International Sale of Goods, shall apply to all legal relationships between Yuzzon and the customers of the service. The place of performance is the registered office of Yuzzon. Unless mandatory provisions of consumer protection law preclude it, the competent court in Vienna shall be deemed agreed upon for any relevant matters.
